The Dummit Law Firm represents those in toxic tort cases who have received exposure to chemicals and environmental agents that lead to claims of personal injury, medical monitoring, fear of future illness and damages to real property. These can arise from exposure to chemicals from such diverse sources as workplaces, products, air emissions, hazardous material releases, explosions/accidents and food. The nature of these cases range from class actions to a single plaintiff. Our attorneys have graduate level training in toxicology and chemical engineering.

The Dummit Law Firm was the first law firm to file an action after the Apex Toxic Waste Fire in the fall of 2006 and is still pursuing the claims for multiple victims of that tragedy.

The National Environmental Policy Act (NEPA) was passed in 1970 along with the Environmental Quality Improvement Act, the National Environmental Education Act and the Environmental Protection Agency (EPA). The main objective of these federal enactments was to assure that the environment be protected against both public and private actions that failed to take account of costs or harms inflicted on the eco-system.

The EPA is supposed to monitor and analyze the environment, conduct research, and work closely with state and local governments to devise pollution control policies. NEPA (really enacted in 1969) has been described as one of Congress's most far reaching environmental legislation ever passed. The basic purpose of NEPA is to force governmental agencies to consider the effects of their decisions on the environment.

State laws also reflect the same concerns and common law actions allow adversely affected property owners to seek a judicial remedy for environmental harms.

Toxic Torts are injuries caused by a toxic substance or material. These materials, often released into the air or water by nuclear factories or into the ground after being dumped into carelessly lined or unlined landfills, are frequently linked to lung cancer, leukemia, brain and other organ damage and birth defects. Victims are usually exposed at work, at play and at home. Sadly, there is not much people can do to prevent exposure. It is up to corporate America and the U.S. Government to step up prevention control measures. However, you can be compensated for these injuries even if you could not prevent them. If you have been a victim of exposure, you can file a lawsuit. If the court finds that your injuries are directly linked to exposure, you and your family may be awarded compensation to cover your medical costs and emotional trauma expenses. Often, toxic tort cases are brought forth as class action suits because of the large number of plaintiffs.

Toxic Tort Litigation is a complicated, convoluted and time-consuming legal process. Because injuries caused by toxic torts often do not surface until years, even decades, after exposure, an example being mesothelioma a lung disease caused by inhalation of asbestos, these cases can be quite difficult to prove. People must demonstrate not only that they were exposed but also it caused the adverse effects and injuries they now experience. This is difficult to do. Fortunately, however, people in toxic tort cases do not need to prove their cases beyond reasonable doubt, as is needed in criminal cases. They instead need to prove only that their claims are more likely to be true than not.
